1. Who you're agreeing with

"Aubrise" / "we" / "us" refers to Zhen Shao trading as Aubrise, a sole trader with ABN 13 660 422 503, registered in Victoria, Australia. Contact: hello@aubrise.com.

By downloading or using Aubrise ("the App"), you agree to these Terms. If you don't agree, please don't use the App.

2. What Aubrise is — and what it isn't

Aubrise is a wellness and information tool that reads data you've voluntarily shared from Apple HealthKit and presents a daily brief and weekly report.

Aubrise is NOT: - a medical device - a diagnostic tool - a treatment or therapy - a substitute for professional medical advice - an emergency service

If you're experiencing chest pain, difficulty breathing, or any medical emergency: stop using Aubrise and call 000 (Australia) / 911 (US) / 112 (EU) / 999 (UK) or your local emergency number immediately.

3. Eligibility

You must be at least 13 years old (in the US) or 16 years old (in the EU/UK), or the minimum age required by your country, to use Aubrise. If you are under 18, you represent that your parent or legal guardian has reviewed these Terms.

4. Your Apple HealthKit data

Aubrise only accesses the HealthKit data types you explicitly grant permission for. You can revoke access at any time via iOS Settings → Privacy & Security → Health → Aubrise. Revoking access may reduce or disable app functionality.

We process your data as described in our Privacy Policy (https://aubrise.com/privacy). In short: raw data stays on your device; only anonymized summaries leave the device.

5. Subscriptions, trials, and billing

5.1 What's on offer

• 7-day free trial of all features (first-time subscribers only)
• Monthly: AUD $4.99 per month, auto-renewing
• Yearly: AUD $29.99 per year, auto-renewing

Prices in local currency are shown in-app and may vary by region per Apple App Store pricing tiers.

5.2 Billing mechanics

All payments are processed by Apple through your App Store account. We never see or handle your payment details.

• Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before renewal
• Your App Store account is charged upon confirmation of purchase
• The free trial converts to a paid subscription automatically unless cancelled at least 24 hours before the trial ends

5.3 Managing and cancelling

To manage or cancel: open iOS Settings → [your name] → Subscriptions, or visit https://apps.apple.com/account/subscriptions.

Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.

5.4 Refunds

Refunds are handled by Apple per App Store policy. Apple's refund page: https://reportaproblem.apple.com. We do not issue refunds directly.

5.5 Free version

After the trial ends, if you don't subscribe, you retain access to the core daily brief on a limited basis (quota may apply). Paid features — weekly deep reports, 12-month trends, voice playback, data export — become locked.

6. What you can't do

You agree not to:

• use Aubrise for any medical emergency
• reverse engineer, decompile, or disassemble the App (except to the extent permitted by applicable law)
• attempt to access our backend other than through the App's legitimate API calls
• use the App to harm others, distribute malware, or for illegal purposes
• resell, redistribute, or license the App to anyone

7. Intellectual property

The App, its design, its text generation prompts, and the Aubrise name and logo are owned by Zhen Shao. You get a personal, non-transferable, non-exclusive license to use the App for personal non-commercial purposes.

The morning brief and weekly report text generated for you is yours to use personally — but you may not redistribute it under your own brand or commercial product.

8. Disclaimers

Aubrise is provided "as is". We make no warranty that:

• the App will be error-free or uninterrupted
• the AI-generated brief or report is accurate, complete, or suitable for any particular purpose
• Apple HealthKit data itself is accurate (this is Apple's domain, not ours)

We are not doctors. Content in the App is for general wellness information only. Always consult a qualified healthcare professional for medical questions.

9. Limitation of liability

To the maximum extent permitted by law:

• our total liability for any claim arising from or related to the App is limited to the greater of (a) the amount you paid to us in the 12 months before the claim, or (b) AUD $50
• we are not liable for indirect, incidental, consequential, or punitive damages
• we are not liable for outcomes related to your health decisions or medical care

Nothing in these Terms excludes liability that cannot be excluded by law (including Australian Consumer Law non-excludable guarantees).

10. Termination

You can stop using Aubrise at any time by deleting the App. We can suspend or terminate your access if you materially breach these Terms. Cancellation of your subscription does not terminate these Terms — Sections 7-12 survive.

11. Changes

We may update these Terms. Material changes will be announced in-app and by updating the "Last updated" date. Continued use after a material change constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria, except where your local consumer protection law provides otherwise.
